Common Types of Sex Crimes in Illinois
Depending on the nature of an offense, a sex crime may be charged as a misdemeanor or a felony in Illinois. Multiple different types of offenses are considered sex crimes, including:
- Sexual assault - Accusations of rape or other forms of forced sexual penetration can result in charges of criminal sexual assault, which is a Class 1 felony. These charges may be elevated to aggravated criminal sexual assault, a Class X felony, if a person is accused of committing sexual assault while using a deadly weapon or inflicting bodily harm. Sexual assault charges may also apply in cases involving date rape or situations where a person was unable to give consent to engage in sexual acts.
- Sexual abuse - Claims that a person has engaged in non-penetrative sexual contact through the use of force or against a person who is unable to give consent can result in charges of criminal sexual abuse, which is a Class 4 felony. Statutory rape involving sexual penetration with a person under the age of 17 may also be charged as criminal sexual abuse, and this is a Class A misdemeanor.
- Child pornography - Possession of images, videos, or other depictions of children under the age of 18 engaging in sexual acts can result in child pornography charges. These offenses may be charged as Class 3 felonies, but charges may increase depending on the nature of the materials, the age of the child depicted, and other factors. Creating or distributing child pornography will result in more serious charges, up to a Class X felony.
- Prostitution - Engaging in sexual acts for money or other forms of compensation can result in charges of prostitution, which is a Class A misdemeanor. Solicitation of a prostitute is also a Class A misdemeanor.
- Harassment and voyeurism - Making an unauthorized video recording of a person in their home or a restroom, changing room, or hotel room is a Class 4 felony. Making an unauthorized recording of a person's body through or under their clothes is a Class A misdemeanor. Sharing sexually explicit photos or videos of a person without their consent, which is commonly known as "revenge porn," is a Class 4 felony. Sending obscene messages, comments, or proposals to a person through email or text messages could result in charges of harassment through electronic communications, a Class B misdemeanor.
